Hit-and-run Missouri Truck Accident Leaves Teenager Seriously Injured

A 15-year-old Turley, Oklahoma boy suffered serious injuries on Tuesday night in a truck accident hit-and-run near Springfield, Missouri. The Missouri truck accident occurred around 10:50 p.m., when the teenager was walking along the shoulder of Interstate 44 west of Springfield. Apparently, the tractor-trailer struck the boy and then struck a red tow truck before leaving the scene of the accident heading West. According to the Missouri Highway Patrol, the tractor-trailer was white and hauling a trailer. It is believed that the tractor-trailer may have red paint marks on it from its collision with the tow truck. The teenager remains in the hospital although there has been no update on the extent of his injuries.

According to Missouri law, the truck driver was legally obligated to stop and help the victim while waiting for emergency officials to arrive. In Missouri it is illegal for anyone to leave the scene, which is damage to persons or damage to property. Because of the truck driver’s negligence and decision to flee the scene of the accident, the driver will face a class D felony when found. In this particular case, it is unclear why the driver left the scene of the accident, but a search is underway for the truck driver. Moscow Mills, Missouri Man Injured in Truck Accident First Week of 2011

The driver, whose name has not yet been released, was driving south of U.S. Highway 61 according to the Missouri Highway Patrol. Commercial Truck Driver Sentence to Probation After Causing Fatal Truck Accident in Missouri

Every day across the nation, commercial truck drivers become distracted while behind the wheel. These distractions cause truck accidents, which sometimes prove fatal. Recently a 33-year-old truck driver was given two years probation for a truck accident that caused the death of two people in Missouri. The fatal truck accident happened a year ago on Missouri Interstate 55. As stated in the Missouri Highway Patrol report, the driver of the truck was “inattentive while driving,” which resulted in a fatal Missouri truck accident. When the driver did look up from whatever was distracting him, he saw several cars stopped in front of him.

Even though the driver says he was following the speed limit at the time of the Missouri truck accident, he swerved but was unable to avoid colliding with two vehicles in front on him. The truck driver said he cannot remember what distracted him, but he thinks that his eyes were only off the road for no more than six seconds. Regardless of how little time his eyes were not on the road, he was unable to react quickly to avoid a collision that turned fatal.

The result of the collision killed two people in the eight-vehicle pileup. One vehicle, driven by a 52-year-old man from Perryville, was dragged 100 yards by the semi-truck. He was pronounced dead at the scene of the Missouri truck accident. The second victim in the fatal Missouri truck accident, a 28-year-old, was airlifted to a hospital in St. Louis where she died shortly after arriving. Semi-truck Driver Summoned to Court

Pearl T. Anderson was summoned to appear in court following a June 2, 2011 truck accident on Interstate 63 as a result of being distracted on the road. Anderson, who drives a semi-truck, apparently was distracted and did not realize that traffic had slowed in front of her. Unable to react in time to slow her big rig, she collided with three other vehicles in front of her. Anderson and six other people were injured in the Missouri truck accident. They were all taken to nearby hospitals and one truck accident victim still remains in the hospital. A spokesperson at the hospital said that the truck accident victim is not seriously injured but requires observation.

A Woman is Injured After Being Smashed Between a Tractor and a Semi-truck

Jeanna Surface had just crossed the Missouri River Bridge on Highway 54/63 in Jefferson City, Missouri when she was slowed by a tractor. Shortly thereafter, semi-truck driver Benjamin Schroyer switched lanes but did not notice the tractor. Once Schoroyer realized that traffic had slowed it was too late and he crashed into the rear end of Surface’s SUV. The force of the semi-truck’s collision with her vehicle caused Surface to slam into the back of the farm equipment, smashing her between the two. Surface was taken to the nearest hospital to be evaluated for her injuries, but there did not appear to be serious injuries. The driver of the semi-truck and the tractor did not sustain injuries in the Missouri truck accident.

It is highly likely that the bridge played a major role in the Missouri truck accident. Many times a bridge will become crowded as vehicles make the crossing. Traffic at each end will become worse, especially when there is a vehicle such as a tractor that cannot go very fast. If the other drivers on the road saw the tractor, it is probable they switched lanes to avoid being behind the farming equipment. It is possible that Schroyer assumed he could avoid the traffic by moving into the opposite lane but did not realize the traffic was avoiding the tractor. Curtis Hawkins Charged in Horrible Wisconsin Truck Accident

Curtis Hawkins Truck AccidentIn order to keep motorists safe on the road, the Federal Motor Carrier Safety Administration regulates commercial trucking companies and tractor-trailer drivers. As a Missouri truck accident attorney, I have mentioned many times throughout my blog that some commercial trucking companies and their drivers do not always follow the safety regulations set forth by the FMCSA. In some cases, tractor-trailer drivers falsify the information in their logbooks to look as though the FMCSA regulations are being followed.

Recently a Missouri tractor-trailer driver was brought up on criminal charges in Wisconsin in connection to a fatal truck accident. According to the Sheboygan Press, Curtis Hawkins from Dexter, Missouri, was charged in the death of two individuals and the injuries of two other individuals. Curtis Hawkins is being accused of not watching the road and failing to stop. Hawkins’ neglect caused his tractor-trailer to hit stopped vehicles at 70 mph. The driver faces two counts of felony reckless driving and two counts of homicide by negligent use of a vehicle. Hawkins could face up to 13 years in prison for the deaths of 78-year-old Donald Sherman from Stickney, Illinois, and 80-year-old Mary Parker of Wisconsin. The tractor-trailer driver could also be charged with two felony counts of reckless driving that caused bodily injury.

According to the Wisconsin State Police, Hawkins had already reached the FMCSA time regulations, but falsified his logbook so he could continue driving. Changing a logbook to show driving hours that follow the FMCSA time regulations is common. Unfortunately, meeting deadlines ensures the compensation of the tractor-trailer driver and the commercial trucking company, so drivers may be willing to lie in order to stay on the road. In some cases, the commercial trucking company will encourage their drivers to falsify their logbooks even though it is illegal. Legal Analysis – I-44 Truck Accident Near Pacific, MO

Several days ago, on November 12, 2010, another catastrophic truck accident occurred on I-44 in Franklin County near Pacific, MO.  The wreck occurred at 1:40 am.  At that time, a 2004 Kenworth Tractor-Trailer (18-wheeler), driven by Jane Rice, was traveling westbound on I-44.  The initial reports are that she crested a hill and then struck a 1994 GMC being driven by Mary Kerbler.  Reportedly, Kerbler’s car was stopped and the semi-truck could not stop in time before it slammed into the rear of the pickup.  The collision sent the truck flying into a rock embankment causing it to flip over.  Below is video footage shot live at the scene.  It is easy to see the destruction caused by this wreck.

Viewing the carnage shown in the video, it is no surprise that this Pacific Truck Accident resulted in multiple serious injuries.  Luckily though, no one was fatally injured.  Both Mary Kerbler and her passenger, were seriously injured and taken by ambulance to St. John’s Mercy Medical Center.  Additionally, both Jane Rice and her passenger, Donald Rice were also listed as having serious injuries and both of them were also taken to St. Johns hospital.

Initially, one might blame Kerbler for being stopped in the road.  However, it is not clear from the initial reports as to why she was stopped, where she was stopped, or even if she was stopped.  Regardless, Missouri Rules of the Road require truck drivers to be able to safely control their vehicles.

Maximizing A Truck Accident Settlement

The Evidence Preservation Letter

First, we send a preservation of evidence letter.  This requires both the drivers and their truck company to preserve specific documentation regarding the driver’s route, logbook, training materials, hiring and qualification documents, etc.  Under the Federal Motor Carrier Safety Regulations, truck companies can dispose of this documentation after a short time period.  And in cases like this, they will.  However, if they do so after receiving an evidence preservation letter, then if the matter went to trial, the jury would likely be given an adverse inference instruction.  This basically tells the jury that they are to assume the documents were destroyed because they contained damning information against the truck company.  When a judge reads this type of instruction to the jury, it can be extremely powerful.

The Truck Inspection

The second thing that should happen immediately is to have an accident reconstructionist examine the truck.  The Federal Motor Carrier Safety Regulations contain many rules about how trucks are to be maintained.  Brakes are especially important.  It may very well be that faulty brakes or worn brakes contributed to the truck driver not being able to stop.  When truck accidents occur as a result of violations of the Federal Motor Carrier Safety Regulations (such as not properly maintaining brakes), then punitive damages are often proper.

The ECM Download

The third thing that should immediately happen is to download the truck’s ECM data.  Like an airplane, most semi-trucks have an Electronic Control Module, or “black-box”.  The ECM records all of the truck’s actions in the moments leading up to the crash.  If could possible tell whether the driver ever hit the brakes, how fast they were going before the crash, and how long they had been driving (where they fatigued because they were driving over the allowed hours?).  The ECM data can be a gold-mine in these cases.  However, unless it is obtained immediately it is often forever lost as the ECM will consistently record over itself if the truck is put back on the road.

Legal Analysis – Semi-Truck Causes Camdenton School Bus Accident

Camdenton, Missouri Truck Accident causes Bus crashAs a Missouri truck accident attorney, I was upset to read that an accident involving a school bus in Camdenton, Missouri, was the result of the negligence of a semi-truck driver. On Friday, October 8, 2010 three cars, a school bus full of children, and a semi-truck were involved in a domino-effect collision that caused significant damage and injuries.

Emergency personnel responded to the five-vehicle pile up in Camden County shortly after the accident at 3:00 p.m. at the 5/7 Junction near Bridal Cave. Three passenger vehicles were southbound waiting to make a left hand turn when a school bus slowed behind them. Before the school bus could make a complete stop it was rear-ended by a semi-truck, which caused the chain reaction. The accident caused a traffic jam for southbound traffic and took over a hour to clean up.

The Camden County Police Department, Camden County Sheriff’s Department, and the Highway Patrol responded to the crash quickly. Of the people involved in the accident, 18 were taken to Lake Regional Hospital, which is located in Osage Beach. Out of the 18 people who were injured, 16 of them were children on the school bus. All the injuries sustained from the accident were considered minor except for one 13-year-old girl who sustained moderate injuries.

One passenger vehicle, the school bus, and the semi-truck sustained major damage during the accident. It is still unclear why the semi-truck driver was unable to stop, but the negligence on the driver’s part put the lives of many children in danger. Truck accidents happen more often than they should and many do not have such a positive outcome. In my experience as a Missouri semi-truck accident attorney, I have helped many families answer the questions that follow an accident that results in injury.

Legally, there are a few things going on here.  First, Missouri employs the rear-end collision doctrine.  This is a legal principle which basically holds that a driver who rear-ends another is responsible for causing the wreck.  This appears to be the case here in that the semi-truck driver was responsible for rear-ending the bus.  However, the bigger issue with truck accident cases is WHY DID THIS HAPPEN.  We can often find these answers by downloading the ECM or (black-box) data from the truck if we are brought in early enough.  Like a plane, the black box data records everything the truck driver was doing in the moments before the crash.  We can find out if he was speeding, if he ever hit the breaks, if he had a habit of speeding, etc.  However, this has to be recovered immediately as truck companies often repair the truck as soon as possible to get it back on the road and the ECM will continue to record over itself.

Getting this ECM data as well as other documentation which the federal government requires the truck companies to maintain is often what allows us to impose punitive damages and thus maximize the truck accident settlement.

On June 7, 2010, a very serious wreck occurred involving three tractor-trailer semi trucks. Involved in the crash were Randall Huff of London, Kentucky, Rodney Harrison of Wellington, Missouri, and Piotr Kwiatkowski of Newington, Connecticut. According to the reports, the accident occurred when Freightliner semi-truck driven by Randall Huff lost control and ran off the left side of the roadway. Huff’s tractor-trailer struck the median and crossed into the westbound traffic lanes. In doing so, he collided into the Peterbilt semi-truck driven by Rodney Garrison. This collision caused both 18-wheelers to overturn in the roadway. Finally, as the 2007 Freightliner driven by Piotr Kwiatkowski approached, he attempted to avoid the overturned trucks but was unable to do so and struck the rear of Garrison’s truck.

This is an example of the destruction that can be caused by one inattentive truck driver.  Unfortunately, the injuries were very severe.  Both Huff and Kwiatkowski were lifeflighted from the scene due to the severity of their injuries.

For example, what is not currently being reported is why Huff ran off the road to begin with. As in all truck accident cases, this examination should begin with the driver’s logs. It is likely that the Missouri Highway Patrol has conducted an extensive investigation resulting in a reconstruction report, although such is not being reported. Of course, what is most important at this time is the health of those involved. Certainly we wish the best to both Huff and Kwiatkowski and hope for speedy recoveries.
