Commercial Trucking Company Destroys Evidence

Post Date: September 5th, 2011

Knight Transportation, a trucking company implicated in a civil lawsuit, was found guilty of destroying evidence. Many Missouri truck accident victims may assume that a legitimate commercial trucking company wouldn’t break the law just to avoid paying the accident victim, but destruction of evidence is very common in the trucking industry. Because destruction of evidence is so common, it is important for Missouri truck accident victims to hire an attorney just so your rights will be protected.

The truck accident happened in Texas and a federal judge stepped in to rule against Knight Transportation for destruction of evidence. In his ruling the judge stated, “[The Driver's] flight from the accident scene and Knight’s hasty replacement of the truck’s tires are the epitome of bad faith conduct. [The driver's] flight from the accident scene and Knight’s hasty replacement of the truck’s tires are the epitome of bad faith conduct. Surely the driver, a professional truck driver, knew that fleeing the accident scene not only violated the law but would necessarily thwart evidence recovery efforts on the truck. Likewise, Knight’s replacement of the truck’s tires within two days of the fatality accident, after its driver fled the scene and the state, cannot seriously be labeled anything less than intentional conduct.”

Fleeing the scene of an accident and destroying evidence is a good way to get yourself into more trouble with the law. When a commercial trucking company participates in these unlawful moves, they should be seriously punished. The fault of a truck driver or commercial trucking company is one of the major factors, but truck insurance companies will try to limit the amount paid out to the victim, so it is important that you do not leave it up to them. The services of an experienced Missouri truck accident attorney are important so your rights are looked after in the event of an accident. Call 888.SUE.TRKS to speak to one of our experienced Missouri truck accident attorneys and learn what your rights are as a victim.

Third Fatal Missouri Truck Accident in as Many Months

Post Date: July 29th, 2011

As a Missouri truck accident attorney, I believe it is my responsibility to report yet another commercial truck accident just south of St. Louis that claimed another life. This accident will mark the third fatal semi-truck accident in Missouri over the past three months. The cause of the accident was a distracted truck driver. Jay Valentine, a 32-year-old, was distracted as he came to the McNutt Road overpass northbound on I-55 in Herculaneum, Missouri. As Valentine came upon the passing lane, he clipped a small passenger vehicle causing a six-car pileup. An investigation into the accident and Valentine’s conduct is ongoing as local authorities are going through evidence to see if there is enough to prosecute him in the deaths of two people and numerous serious injuries.

The Missouri truck accident in Herculaneum resulted in the deaths of 28-year-old Alana McKnight and 52-year-old Charles Martin. The departed were driving separate vehicles at the time of the accident. As a Missouri truck accident attorney, I have reviewed photographs of the accident that indicate both vehicles were crushed into a highway wall and were barely recognizable. So why were innocent lives lost to another distracted driver and what is being done to prevent more loss in the future? We are constantly lobbying for stricter safety regulations for commercial trucking companies and drivers, which include bans on cell phone use and other distracting electronic equipment that are not useful for the truck driver to do his or her job.

Time after time in Missouri truck accident cases we uncover a severe level of distraction. Once the data from the tractor-trailer’s Electronic Control Module is downloaded, there is a clearer understanding on what caused the accident. The ECM is essentially a commercial truck’s black box that allows a glimpse into the moments that lead up to a collision. Experienced Missouri tractor-trailer attorneys will file a protective order in the court to receive a copy of the data that many trucking companies will try to dispose of to make it difficult for victims to prove liability.

After a devastating accident such as this most recent fatal Missouri truck accident, most families don’t think about the money. Over time, funeral costs and bills begin to start piling up and paychecks stop for the victims. In the event of a devastating truck accident, an attorney should be contacted immediately. An experienced attorney will need to protect the evidence such as the ECM data, log books, receipts, and other forensic evidence. Failure to protect this information could result in injustice to the victims and his or her families. If you or someone you love has been injured or killed by the negligence of a truck driver or the company they work for, please call 888.956.2487 for a free consultation and let us help you through this difficult time.

Missouri Truck Accident Settlement Formula

Post Date: July 26th, 2011

As a Missouri truck accident attorney, many people ask me if there is actually a truck accident settlement formula or known in many circles as a ‘base formula’. This mathematical formula is used to determine the amount of a settlement to be made as a result of a Missouri truck accident. When dealing with property damage, this mathematical formula calculates the monetary amount allowed for damage of a truck accident. After a truck accident, the damage to the car and any personal belongings must be assessed and documented for your claim.

When you look at any personal injury claim, it is much more complex than a property damage claim after a Missouri truck accident. In order to have a successful injury claim, you and any other victims in the truck accident should document your physical injuries and pain. You should also keep detailed records of all emotional traumas, medical bills, and lost wages. All financial loss directly related to the truck accident should be documented because you will need to be compensated for the negligence of another.

There are many other factors that must be taken into account in the event of a Missouri truck accident. The fault of a truck driver is one of the major factors, but truck insurance companies will try to limit the amount paid out to the victims, so it is important that you do not leave it up to the insurance company. The services of an experienced truck accident attorney in Missouri are important so your rights are looked after in the event of an accident. Call 888.956.2487 to speak to one of our experienced truck accident attorneys and learn what your rights are as a victim.

Commercial Trucking Industry Nets High Profits, Causes 500,000 Accidents

Post Date: July 18th, 2011

As a truck accident attorney in Missouri, I meet many people affected by negligent truck drivers. Currently the commercial trucking industry nets over $600 billion dollars a year and that number is expected to almost double by the year 2015. Even as the current trucking industry is booming, tractor-trailers create hazardous conditions for Missouri drivers. According to the United States Department of Transportation, more than 500,000 truck accidents happen nationwide each year. Out of this number, nearly 5,000 of these accidents result in death. With the increasing hazards commercial trucks have on other drivers, here are some ways to avoid trucking accidents.

  • When you are near a tractor-trailer, use extra caution and stay alert.
  • If you are near a commercial truck, give them plenty of room to turn or navigate through construction zones.
  • When the weather is bad, give tractor-trailers more room on the road. Weather can limit the acceleration, stopping, and maneuvering of commercial trucks.
  • Try to avoid driving in a tractor-trailer’s blind spots, so they know you are on the road.
  • Always give the commercial truck enough room when you’re passing them.

When you see a truck driving badly, you can usually see a phone number to call that is posted at the back. If you see an erratic or negligent driver, Missouri truck accident attorneys advise that you report the driver. Even though it is much safer to have a passenger in your vehicle to make the call, it is important that negligent drivers need to be reported because they could endanger many other lives.

No tractor-trailer accident is the same. Tractor-trailer accidents can happen when a driver is fatigued or makes bad decisions; when a commercial trucking company chooses not maintain their trucks or use faulty equipment; and when they choose to put the public’s safety behind making a profit.  If the commercial trucking company has injured you by a negligent truck driver or because of negligent decisions, please contact an experienced Missouri truck accident attorney immediately. The longer a tractor-trailer accident victim waits to hire an attorney, the less evidence that will be available to fight for compensation. Call 888.956.2487 to speak to one of our experienced Missouri truck accident attorneys about your tractor-trailer accident injury claim.

Why You Should Hire A Missouri Truck Accident Lawyer

Post Date: February 14th, 2011

Missouri truck accident attorneys focus on serious injuries and wrongful deaths that are the result of negligent tractor-trailer driver’s and the companies that hire them. Tractor-trailer drivers and commercial trucking companies have different responsibilities forced on them by the Federal Motor Carrier Safety Regulations, which are designed for public’s safety. As a Missouri truck accident attorney, I have successfully collected millions of dollars in compensation for victims of negligent tractor-trailer drivers and the commercial trucking companies.

Our experienced truck accident attorneys stay up-to-date on the recent changes in legislation, laws, and regulations that affect the commercial trucking industry. My goal is to educate motorists that commercial trucking companies routinely violates the standards set forth by the Federal Motor Carrier Safety Administration. By ignoring the regulations, tractor-trailer drivers and the companies they work for are putting innocent motorist in Missouri in danger.

When a tractor-trailer driver and the commercial trucking companies cut corners, the outcome can be devastating. The people and families affected by a Missouri truck accident are the ones who are left to pick up the pieces. Over time the bills begin to pile up and the incoming wages stop because injury or death prevents victims from working.

If you or someone you love has been injured by the negligence of a truck driver or the company they work for, please call 877.SUE.TRKS for a free consultation and let us help you through this difficult time.

Curtis Hawkins Charged in Horrible Wisconsin Truck Accident

Post Date: January 31st, 2011

Curtis Hawkins Truck AccidentIn order to keep motorists safe on the road, the Federal Motor Carrier Safety Administration regulates commercial trucking companies and tractor-trailer drivers. As a Missouri truck accident attorney, I have mentioned many times throughout my blog that some commercial trucking companies and their drivers do not always follow the safety regulations set forth by the FMCSA. In some cases, tractor-trailer drivers falsify the information in their logbooks to look as though the FMCSA regulations are being followed.

Recently a Missouri tractor-trailer driver was brought up on criminal charges in Wisconsin in connection to a fatal truck accident. According to the Sheboygan Press, Curtis Hawkins from Dexter, Missouri, was charged in the death of two individuals and the injuries of two other individuals. Curtis Hawkins is being accused of not watching the road and failing to stop. Hawkins’ neglect caused his tractor-trailer to hit stopped vehicles at 70 mph. The driver faces two counts of felony reckless driving and two counts of homicide by negligent use of a vehicle. Hawkins could face up to 13 years in prison for the deaths of 78-year-old Donald Sherman from Stickney, Illinois, and 80-year-old Mary Parker of Wisconsin. The tractor-trailer driver could also be charged with two felony counts of reckless driving that caused bodily injury.

According to the Wisconsin State Police, Hawkins had already reached the FMCSA time regulations, but falsified his logbook so he could continue driving. Changing a logbook to show driving hours that follow the FMCSA time regulations is common. Unfortunately, meeting deadlines ensures the compensation of the tractor-trailer driver and the commercial trucking company, so drivers may be willing to lie in order to stay on the road. In some cases, the commercial trucking company will encourage their drivers to falsify their logbooks even though it is illegal. The longer a tractor-trailer drivers past the federal hour of service limit means that there is more room for error.

It’s disappointing that the commercial trucking industry is not more concerned with the safety of the public. When a Missouri tractor-trailer accident happens because of negligence, truck accident attorneys can file for compensation for the victims. Compensation for injuries or wrongful death can help the victim or their family pay for past and future medical bills and lost wages. If you have been injured in a Missouri truck accident or you have lost a loved one because of a negligent truck driver, call an experienced truck accident attorney. You need someone fighting for your rights, so call 877.SUE.TRKS for a free consultation to discuss your claim.

Trucking Industry Insider Claims Truck Companies Routinely Break Safety Regulations

Post Date: January 11th, 2011

Missouri Truck Accident LawyerMotorists must share the road with tractor-trailer drivers and they want to feel safe. The Federal Motor Carrier Safety Administration helps regulate the trucking industry in an effort to reduce the number of tragic truck accident across the nation. As a Missouri truck accident attorney, I came across a recent South Carolina news report that raised some important questions about how the trucking industry really regulates their drivers’ compliance to safety regulations. According to the news story, a tractor-trailer driver from Gaston, South Carolina, comes clean about truck industry safety practices.

The driver claimed that the shipping trucking company he worked for fired him because he refused to violate FMCSA safety regulations to make a deadline. The driver also accused his former employer of falsifying logbooks to appear to be in compliance with the safety regulations, which he suggested is very common in the industry. The hours of service regulations are guidelines that require tractor-trailer drivers to get a certain number of hours of sleep while they are on the road. The FMCSA put the regulations on trucking companies and the tractor-trailer drivers to prevent truck accidents that are related to fatigue.

The driver from Gaston, S.C. claimed that four hours of sleep between driving long hours is the industry standard. If the allegations are proven correct, there will be a lot of questions. Trucking companies in Missouri and across the country could be audited and charges could be possible. According to the South Carolina news report, one solution that has been proposed is installing a device similar to an aircraft’s black box to record the movement of a tractor-trailer. The device would limit the trucking companies’ ability to forge the tractor-trailer drivers’ logbooks. Trucking industry would be forced to be in compliance to the hours of service regulations and make driving safer for motorists.

It’s disappointing that trucking companies are not more concerned with motorist safety, but truck accident victims can still hold them accountable for their intentional negligence. If you have been injured in a truck accident, speak to an experienced Missouri truck accident attorney. If the trucking companies are not going to follow the safety regulations, then they should be held liable for the serious injuries or wrongful death. Call 877.SUE.TRKS (783-8757) to speak to one of our experienced Missouri truck accident attorneys to schedule a free consultation. We’ll help you understand your rights as a victim and fight for your compensation.

Why You Should Not Wait To Consult A Missouri Truck Accident Lawyer

Post Date: January 9th, 2011

Hiring A Missouri Truck Accident LawyerIf you’ve suffered injuries in a tractor-trailer accident, you may be overwhelmed with medical expenses and ongoing treatment that you may not realize you need to make a decision. Missouri truck accident attorneys understand the emotional rollercoaster that follows a serious tractor-trailer accident, but it is important to see an attorney soon after the crash. Trucking companies have a frontline of professionals they use to defend their money. They will do everything they can to limit the amount of money they pay to tractor-trailer accident victims.

In Missouri, you have up to 5  years to file a lawsuit in a personal injury case, but if you wait too long you could lose important evidence. The sooner you hire an experience Missouri truck accident lawyer, the better chance you have to uncover any violations of FMCSA safety regulations. If a trucking company is in violation to the safety regulations, it could result in compensation for injuries or wrongful death. A Missouri tractor-trailer accident lawsuit usually includes a claim of negligence on the tractor-trailer driver and the employer’s behalf.

Trucking companies that operate under the authority of the Department of Transportation are responsible for screening and training their truck drivers. When a bad tractor-trailer driver slips through the cracks and causes a Missouri truck accident, the company is negligent. The Eastern District Federal Court of Missouri has decided that trucking companies, who are in breach of safety regulations, offer evidence that they knowingly had no regard for the safety of motorists on the road. If the evidence has been established in a civil court, the victims of the tractor-trailer accident could receive compensation.

Although the decision by the court offers tractor-trailer accident victims more rights in the courtroom, the injured should contact an experienced Missouri truck accident law firm immediately. The trucking companies send out investigators to collect evidence immediately after the accident. If the trucking and insurance companies do not receive a “preservation of evidence” letter, then they could dispose of evidence that is crucial to the personal injury claim. Call 877.SUE.TRKS to speak to an experienced Missouri truck accident attorney and let us be on your side.

Legal Analysis – I-44 Truck Accident Near Pacific, MO

Post Date: November 16th, 2010

Several days ago, on November 12, 2010, another catastrophic truck accident occurred on I-44 in Franklin County near Pacific, MO.  The wreck occurred at 1:40 am.  At that time, a 2004 Kenworth Tractor-Trailer (18-wheeler), driven by Jane Rice, was traveling westbound on I-44.  The initial reports are that she crested a hill and then struck a 1994 GMC being driven by Mary Kerbler.  Reportedly, Kerbler’s car was stopped and the semi-truck could not stop in time before it slammed into the rear of the pickup.  The collision sent the truck flying into a rock embankment causing it to flip over.  Below is video footage shot live at the scene.  It is easy to see the destruction caused by this wreck.

Viewing the carnage shown in the video, it is no surprise that this Pacific Truck Accident resulted in multiple serious injuries.  Luckily though, no one was fatally injured.  Both Mary Kerbler and her passenger, were seriously injured and taken by ambulance to St. John’s Mercy Medical Center.  Additionally, both Jane Rice and her passenger, Donald Rice were also listed as having serious injuries and both of them were also taken to St. Johns hospital.

Initially, one might blame Kerbler for being stopped in the road.  However, it is not clear from the initial reports as to why she was stopped, where she was stopped, or even if she was stopped.  Regardless, Missouri Rules of the Road require truck drivers to be able to safely control their vehicles.

Maximizing A Truck Accident Settlement

As a Missouri Truck Accident Attorney handling cases like these throughout all of Missouri, there are immediate actions that should be taken in order to maximize a truck accident settlement.

The Evidence Preservation Letter

First, we send a preservation of evidence letter.  This requires both the drivers and their truck company to preserve specific documentation regarding the driver’s route, logbook, training materials, hiring and qualification documents, etc.  Under the Federal Motor Carrier Safety Regulations, truck companies can dispose of this documentation after a short time period.  And in cases like this, they will.  However, if they do so after receiving an evidence preservation letter, then if the matter went to trial, the jury would likely be given an adverse inference instruction.  This basically tells the jury that they are to assume the documents were destroyed because they contained damning information against the truck company.  When a judge reads this type of instruction to the jury, it can be extremely powerful.

The Truck Inspection

The second thing that should happen immediately is to have an accident reconstructionist examine the truck.  The Federal Motor Carrier Safety Regulations contain many rules about how trucks are to be maintained.  Brakes are especially important.  It may very well be that faulty brakes or worn brakes contributed to the truck driver not being able to stop.  When truck accidents occur as a result of violations of the Federal Motor Carrier Safety Regulations (such as not properly maintaining brakes), then punitive damages are often proper.

The ECM Download

The third thing that should immediately happen is to download the truck’s ECM data.  Like an airplane, most semi-trucks have an Electronic Control Module, or “black-box”.  The ECM records all of the truck’s actions in the moments leading up to the crash.  If could possible tell whether the driver ever hit the brakes, how fast they were going before the crash, and how long they had been driving (where they fatigued because they were driving over the allowed hours?).  The ECM data can be a gold-mine in these cases.  However, unless it is obtained immediately it is often forever lost as the ECM will consistently record over itself if the truck is put back on the road.

Of course, these things can only be accomplished through Truck Accident Specialist.  Truck Accident cases are vastly different than a “run of the mill” car accident case because they require specialized knowledge of the not only the trucking industry but also the Federal Motor Carrier Safety Regulations.

Think Twice Before Trying To Settle With the Truck Insurance Company

Post Date: November 12th, 2010

Settling Truck Accident CaseHandling an insurance claim can be a challenge when you are involved in a Missouri car accident, but in the event of a Missouri tractor-trailer accident it becomes more difficult. Some people believe that if they are injured in a tractor-trailer accident, they can obtain a fair truck accident settlement on their own with the insurance company. In a perfect world, this would be true but the reality is that the insurance company does not have your best interest in mind. The process of filing a personal injury claim with a trucking company’s insurance is a daunting process that will only get worse without the help of an experience Missouri truck accident attorney.

In the event of a tractor-trailer accident, the trucking company calls its insurance provider. The insurance company sends a team of investigators to the scene of the accident to collect evidence and take statements. The insurance company will than review the evidence and contact the victim to record a statement. If you make a statement to the insurance company, you can seriously jeopardize your personal injury claim. Insurance companies are known for wording their policies so that they are difficult for regular people to read, which leaves the victim confused and unprotected. The insurance company will bombard you with paperwork and make it almost impossible for you to collect for your personal injures.

The insurance companies will treat you like a number and do everything in their power to avoid paying large sums of money regardless whether or not their policyholder is at fault. They will not be sympathetic to your injuries or be concerned about your quality of life once the case is closed. When an experienced Missouri truck accident lawyer steps in, the insurance company knows that there is no way to bully you into a low settlement. You shouldn’t have to worry whether or not the insurance company is going to pay you because you need to take the time to recover from your injuries. Hiring an experienced truck accident attorney to be on your team takes the stress out of the process, so you can worry about your recovery. Call 877.SUE.TRKS today and speak to one of our experienced attorneys to discuss your claim and learn how to maximize your settlement.
