The Commercial Motor Vehicle Safety Alliance Holds 2011 Roadcheck

In June of this year the Commercial Motor Vehicle Safety Alliance (CMVSA) held its annual Roadcheck. The Roadcheck 2011 event asks that all states inspect commercial trucks on their roads. According to the CMVSA, under 1% of the trucks on the U.S. roads are inspected. By announcing the Roadcheck 2011 event, the CMVSA gave commercial trucking companies and their drivers four months to prepare and fix problems related to the trucks. If the problems were serious, they even had the option of staying off the road for a few days until the Roadcheck event was over.

Even though the CMVSA’s Roadcheck 2011 was highly publicized and the commercial trucking industry was aware of the inspections, the three-day inspection found nearly 20% of the trucks failed the Level 1 inspection. 76-year-old Truck driver Causes Missouri Head-on Collision Accident

A Lafayette County, Missouri tractor-trailer head-on accident caused serious injury to another driver after losing control on US Highway 24. David Lauer, a 76-year-old truck driver, lost control and crossed into oncoming traffic crashing head-on with 24-year-old Derek Petre. Lauer was eastbound on US 24 when his semi-truck randomly traveled into westbound traffic. Petre of Macon, Missouri was severely injured in the head-on collision and was transported to Lafayette County Regional Medical Center.

The Missouri State Highway Patrol are investigating the Missouri truck accident, gathering evidence for pending charges against Lauer. At this time, the cause for Lauer to lose control of the tractor-trailer is unknown. Sleep Apnea Major Cause For Truck Accidents in Missouri

Sleep apnea is a disorder that causes people to have brief interruptions in their breathing during sleep. Sleep apnea may not sound like a dangerous disorder, but according to the scientific research available the disorder interferes with safe driving. After the collision, the vehicles slid off the right side of the road. The crash is under investigation to find out the exact cause of this tragedy.

Fatigued Driver Falls Asleep at the Wheel and Shuts Down I-44

On June 9, 2011 a truck hauling a full-sized trailer crashed in the early morning hours on I-44 near Springfield, Missouri. According to ozarkfirst.com, the accident happened when the driver of the truck fell asleep at the wheel. The driver woke up as his truck began to cross the lanes of the highway. When he tried to correct the truck with the trailer, he overcorrected. The overcorrection caused him to hit the rock barrier on the side of the road. Fortunately the driver was not injured and no other vehicles were involved in the Missouri truck accident. Even there were no injuries, the truck accident shut down I-44 and slowed morning traffic while the accident debris was cleared from the highway.

Trucking Industry Goes Before Congress about New Hours of Service

Missouri tractor-trailer accident attorneys have written many times on the new federal rules that limits the number of hours truck drivers are allowed to work each day. The reason this topic is so important is because it limits the number of tractor-trailer accidents in Missouri that are fatigue-related. Although this new rule was put into effect in order to protect motorists, it does put a limitation on the trucking industry’s profits. Because this new rule is limiting a truck driver’s time on the road, it is no surprise that the trucking industry has testified in front of congress against the new hours of service rules.

In the June 14, 2011 publication of The Trucker, an article was written about a representative from the American Truck Association. According to this article, the representative spoke to a Congressional House subcommittee about what the new hours of service rules will cost the industry. The new hours of service rules is slated to begin in October. The owner of a trucking company in Michigan, James Burg, explained to the subcommittee that this new rule would require him to hire more workers to do what his current staff already does, ultimately driving up his costs.

The new hours of service regulations would limit the allowable driving hours per day to 10 hours from 11 hours. The total numbers of hours a driver can work, including paperwork, will be cut from 14 hours to 13 hours. The new rules will also require a driver to take a mandatory break of 30 minutes after driving for seven hours. James Burg, who sits on the ATA Board of Directors, told congress that the cost of hiring new drivers would get passed onto the customers, which would make his customers likely pass on service. The ATA’s position on the new hours of service is that the current rules are working fine for both sides.

I understand that the trucking industry opposes the new rules because it could cost additional money, but are the lives of motorists less important than a potential profit? Fatigued driving has become a serious problem for the trucking industry as well as motorists. Longer shifts save money for the trucking industry, but it also creates the risk that drivers are too tired to operate such a powerful vehicle. The trucking industry argues that customers will pay the price for the new hours of service by price increases on goods. However, I believe that people will be more willing to pay more for groceries if it lowers the risk that they might lose a loved one because of a fatigued truck driver.

Even with the new hours of service, the risk of a truck driver causing a Missouri truck accident because they are tired. Even with the rules, truck drivers will ignore them either to make a timely delivery or at the request of the employer. New Driving Hours Regulation Considered To Lessen Driver Fatigue

As a Missouri truck accident attorney, I was glad to hear that the Federal Motor Carrier Safety Administration may be shortening the time semi-truck drivers are allowed to drive at one time. Semi-truck drivers and the commercial trucking companies they work for have different responsibilities imposed on them by federal safety regulations, each designed with the public’s safety in mind.

It is unclear when the FMCSA will change the maximum time semi-truck drivers will be allowed to stay on the road and how much time will be cut from the current hours of service. Trucking Industry Insider Claims Truck Companies Routinely Break Safety Regulations

The Federal Motor Carrier Safety Administration helps regulate the trucking industry in an effort to reduce the number of tragic truck accident across the nation. According to the news story, a tractor-trailer driver from Gaston, South Carolina, comes clean about truck industry safety practices.

The driver claimed that the shipping trucking company he worked for fired him because he refused to violate FMCSA safety regulations to make a deadline. The driver also accused his former employer of falsifying logbooks to appear to be in compliance with the safety regulations, which he suggested is very common in the industry. The hours of service regulations are guidelines that require tractor-trailer drivers to get a certain number of hours of sleep while they are on the road. The FMCSA put the regulations on trucking companies and the tractor-trailer drivers to prevent truck accidents that are related to fatigue.

The driver from Gaston, S.C. claimed that four hours of sleep between driving long hours is the industry standard. If the allegations are proven correct, there will be a lot of questions. Trucking companies in Missouri and across the country could be audited and charges could be possible. According to the South Carolina news report, one solution that has been proposed is installing a device similar to an aircraft’s black box to record the movement of a tractor-trailer. The device would limit the trucking companies’ ability to forge the tractor-trailer drivers’ logbooks. Trucking industry would be forced to be in compliance to the hours of service regulations and make driving safer for motorists.

Sleep deprivation effects everyone, but when it impairs a truck driver’s ability to stay alert on the road, innocent people can get hurt.
