FMCSA Changes Safety Rating Designations Under Pressure From Truck Industry

As a Missouri truck accident attorney, I have written about the Federal Motor Carrier Safety Administration and how they aim  to keep motorists safe on the roads. Recently the FMCSA changed its rating system for the CSA 2010 program, which means it will no longer categorize carriers as deficient.

On November 18, 2010 the new CSA 2010 rating was announced. The new rating system will replace the “deficient” category with an alert. The former CSA rating categorized the trucking company, the truck driver, and the tractor-trailer as deficient if they were in the considered to be in the lowest 25% in terms of safety ratings.  The CSA 2010 rating will replace “deficient” with “alert” when the company, driver, or tractor-trailer is above the FMCSA’s standards for basic safety.

The reason for the change in the rating system is to identify the safety violations that are more likely to cause a truck accident. With new algorithms, the government can keep better track of the carriers that are more likely to have a truck accident. The change came after the FMCSA caved to the trucking industry’s outcry to remove “deficient” from the safety ratings. The Federal Motor Carrier Safety Administration did change the way they catorigize the ratings, but they did not change how they try to protect us on the road.

What is disappointing is that the trucking industry is less concerned with the safety of the public and more concerned with how their ratings are seen to the public. Ignoring the Federal Safety Regulations Leads To Semi-Truck Crashes

Unfortunately, large trucking companies ignore too many FMCSA regulations because the rules limit the amount of time a driver stays on the road, which limits the profits to be made. Truck Drivers Fatally Kills Pedestrian in Granite City, IL Accident

You don’t have to be in a motor vehicle to be injured by a moving vehicle. Pedestrians are at risk of serious injury or death every time they cross the road. As a Missouri Truck Accident Attorney, I was saddened to hear that a man from Southern Illinois was killed by a tractor-trailer as he was crossing the intersection of a highway. Truck accidents involving pedestrians are rare, but on November 18th, 2010 it happened in Granite City, Illinois.

Around 3 p.m., 80-year-old Robert Schaefer was crossing the intersection of Illinois Route 3 at the West Chain of Rocks Road to get home. The tractor-trailer and other vehicles were stopped at a red light as Robert Schaefer began crossing the road. When the light turned green, the driver pulled out and hit the victim. Robert Schaefer was taken to Saint Louis University Hospital by helicopter, but died that evening.

The driver of the tractor-trailer told Granite City Police that he did not see the victim and an officer made a statement that there is no crosswalk at the intersection. The tractor-trailer accident is still under investigation, but the authorities do not expect to press criminal charges.  I was curious as to why no charges were to be filed against the truck driver. In Missouri and Illinois, this is not normal when an accident involving a pedestrian, who was legally crossing the intersection.

The police officer’s statement about there not being a crosswalk at the intersection is not based on fact. Truck Company Safety Ratings Show Many Dangerous Drivers On The Road

FCMSA Study regarding dangerous truck driversThe Federal Motor Carrier Safety Administration has regulations that trucking companies have to follow in order to reduce the number of truck accidents. Currently, tractor-trailers make up only 3% of vehicles on the road, but account for 12% of all accidents. As a Missouri truck accident attorney, I keep up with the latest FMCSA reports on trucking companies and their safety ratings.

According to November 2010 data compiled from the FMCSA by Carrier411.com, over 1,500 trucking companies have been given substandard safety ratings. Out of 605,549 trucking companies monitored, 17,880 were given Carriers with Deficient Driver Safety (DRSEA) scores. The amount of carriers with deficient driver safety may seem small compared to the number of trucking companies monitored, but it means that 17,880 companies are releasing their unsafe drivers on the road to endanger the lives of others.

What is more upsetting is the number of trucking companies that send their trucks on the road when the vehicle is not safe to drive. A little over 19,000 trucking companies received deficient vehicle safety scores, which means there are even more tractor-trailers on the road that are putting people at risk. Some may think that this is as bas as it can get, but too many trucking companies do not carry sufficient insurance to cover any injuries or property damage in the event of a trucking accident.

There are 1,060 active trucking companies that operate without liability insurance and 1,089 trucking companies that do not have enough liability insurance. Unfortunately, this means 2,149 trucking companies are putting drivers on the road knowing that if a trucking accident happens, they may not be able to compensate for personal injury and property damage. It is unfortunate that so many trucking companies are willing to operate even at the risk of someone getting hurt.

When winter makes driving a little trickier, motorists need to take extra precautions to stay safe on the road. While driving on an icy road would you tailgate a passenger vehicle? The answer is probably not because it’s dangerous. Following a tractor-trailer on icy and snowy roads is even more dangerous because of the destructive power of the truck. If you follow too closely you may not be able to stop in time to prevent a rear-end collision. As a driver, you also want to keep distance between you and a tractor-trailer in case the truck hits a patch of ice and loses control on the road.

When road conditions are affected by the winter weather, you should always give yourself enough space between other vehicles. This is also very important when driving near a tractor-trailer. If you are passing a truck on the highway, give enough space when you pull in front of the truck. If you cut off a truck on icy roads, there is no guarantee it is going to stop. Truck drivers also run the risk of jackknifing the truck when forced to slam on the brakes.

There is a blind spot for every vehicle, especially tractor-trailers. It is difficult enough for truck drivers to see when the weather is clear, but when it is snowing it is impossible. If you are required to drive near a tractor-trailer, get out of the truck’s blind spot as soon as possible. Remember, if you can’t see the mirrors on the truck then the truck driver can’t see you.

The final tip to drive safely around tractor-trailers this winter is to avoid being in front of a truck on a steep hill. Truck drivers can burn out their brakes by driving on steep hills, which puts other motorists at risk especially on icy roads. If you are driving near a tractor-trailer and you come upon a steep hill, get in the lane opposite the truck. If you are not in front of the tractor-trailer, the driver will have more road to maneuver the truck.

Ban on Texting and Driving Instituted on Truck Drivers

Truck Ban on Texting While Driving Texting while operating a motor vehicle is an ongoing problem because it is dangerous. It is dangerous to text and drive a passenger vehicle, but even more dangerous to text while operating a semi-truck with destructive power. Texting while driving has been the topic of constant debate and the laws are beginning to change. As a truck accident attorney in Missouri, I was happy to find out that a texting ban has finally been placed on truck drivers.

In the early months of 2010, the Secretary of Transportation, Ray LaHood, banned truck drivers from texting while driving in an attempt to minimize tractor-trailer related accidents. When the announcement came, the ban was only a safety regulatory guideline for trucking companies to follow. It wasn’t until the end of October that the Federal Motor Carrier Safety Administration made the text ban an official rule, which became permanent.

The final ruling is specifically aimed at texting and not just talking on the phone while driving. Studies have shown that texting while driving impairs a person’s attention much worse and increases the likelihood of causing a serious accident. Although there are many distractions that exist in semi-truck’s cab, texting while driving is 23 times more likely to cause an accident that results in injury. Support of the ban is widespread, but some groups such as the American Association for Justice doesn’t think the rule goes far enough. Safety advocacy groups want the other distractions in the cab of a semi-truck to be banned.

While texting may have become the preferred way to communicate, we can’t ignore the effects it can have while operation a motor vehicle. The texting ban on truck drivers may reduce the amount of tractor-trailer accidents on the road, but there are many ways a truck driver can become distracted. Legal Analysis – I-44 Truck Accident Near Pacific, MO

Several days ago, on November 12, 2010, another catastrophic truck accident occurred on I-44 in Franklin County near Pacific, MO.  The wreck occurred at 1:40 am.  At that time, a 2004 Kenworth Tractor-Trailer (18-wheeler), driven by Jane Rice, was traveling westbound on I-44.  The initial reports are that she crested a hill and then struck a 1994 GMC being driven by Mary Kerbler.  Reportedly, Kerbler’s car was stopped and the semi-truck could not stop in time before it slammed into the rear of the pickup.  The collision sent the truck flying into a rock embankment causing it to flip over.  Below is video footage shot live at the scene.  It is easy to see the destruction caused by this wreck.

Viewing the carnage shown in the video, it is no surprise that this Pacific Truck Accident resulted in multiple serious injuries.  Luckily though, no one was fatally injured.  Both Mary Kerbler and her passenger, were seriously injured and taken by ambulance to St. John’s Mercy Medical Center.  Additionally, both Jane Rice and her passenger, Donald Rice were also listed as having serious injuries and both of them were also taken to St. Johns hospital.

Initially, one might blame Kerbler for being stopped in the road.  However, it is not clear from the initial reports as to why she was stopped, where she was stopped, or even if she was stopped.  Regardless, Missouri Rules of the Road require truck drivers to be able to safely control their vehicles.

Maximizing A Truck Accident Settlement

As a Missouri Truck Accident Attorney handling cases like these throughout all of Missouri, there are immediate actions that should be taken in order to maximize a truck accident settlement.

The Evidence Preservation Letter

First, we send a preservation of evidence letter.  This requires both the drivers and their truck company to preserve specific documentation regarding the driver’s route, logbook, training materials, hiring and qualification documents, etc.  Under the Federal Motor Carrier Safety Regulations, truck companies can dispose of this documentation after a short time period.  And in cases like this, they will.  However, if they do so after receiving an evidence preservation letter, then if the matter went to trial, the jury would likely be given an adverse inference instruction.  This basically tells the jury that they are to assume the documents were destroyed because they contained damning information against the truck company.  When a judge reads this type of instruction to the jury, it can be extremely powerful.

The Truck Inspection

The second thing that should happen immediately is to have an accident reconstructionist examine the truck.  The Federal Motor Carrier Safety Regulations contain many rules about how trucks are to be maintained.  Brakes are especially important.  It may very well be that faulty brakes or worn brakes contributed to the truck driver not being able to stop.  When truck accidents occur as a result of violations of the Federal Motor Carrier Safety Regulations (such as not properly maintaining brakes), then punitive damages are often proper.

The ECM Download

The third thing that should immediately happen is to download the truck’s ECM data.  Like an airplane, most semi-trucks have an Electronic Control Module, or “black-box”.  The ECM records all of the truck’s actions in the moments leading up to the crash.  If could possible tell whether the driver ever hit the brakes, how fast they were going before the crash, and how long they had been driving (where they fatigued because they were driving over the allowed hours?).  The ECM data can be a gold-mine in these cases.  However, unless it is obtained immediately it is often forever lost as the ECM will consistently record over itself if the truck is put back on the road.
